When you enter into a PitPerks prize draw, you are deemed to have read, understood, and agreed to our Terms and Conditions.
By using this website, you confirm that you have read and understood our Privacy Policy.
PitPerks Limited (“PitPerks” or the “Promoter”) is a private limited company registered under the laws of England and Wales. PitPerks is a for-profit company which operates prize draws (each a “Prize Draw”) on www.pitperks.com (the “Website”).
These Prize Draw Terms and Conditions apply to every Prize Draw operated on the Website on or after 1 October 2024.
If you do not agree to these Prize Draw Terms and Conditions, do not enter any Prize Draw on this Website.
1. Eligibility to Enter a Prize Draw
1.1. In accordance with these Terms and Conditions (the “Terms”), you (“You” or the “Entrant”) can participate in a Prize Draw operated on the Website from which a winner (the “Winner”) is selected at random.
1.2. Prize Draws are open to residents of the United Kingdom aged 18 years or older, excluding employees and directors of the Promoter, their family, and service providers.
1.3. By entering a Prize Draw, You are deemed to have read, understood and accept to be bound by these Prize Draw Terms and Conditions, which may be updated from time to time. Please check this page each time You enter a Prize Draw to ensure You understand the applicable Prize Draw Terms and Conditions when You enter a Prize Draw.
1.4. You are deemed to have the legal capacity to enter the Prize Draw. You are responsible for making sure that entering a Prize Draw is legal in Your country of residence. The Promoter is not responsible for Your unlawful entry into any Prize Draw.
1.5. You are required to register an online account on the Website in order to enter a Prize Draw and You must provide certain personal details, including Your valid email address, for purposes of the Promoter’s operation of the Prize Draw. You are deemed to have read and understood the Website Privacy Policy, and You agree that the Promoter may contact You via email, phone and post in connection with the Prize Draw. Any entries connected to an invalid email address will be declared void and will not be eligible to win.
1.6. You must submit Your entry, or entries (where multiple entries are permitted in a Prize Draw), on the Website as directed by the on-screen instructions. If it is determined that You have used or attempted to use any automated, robotic, or programmatic entry methods (“non-manual entry methods”), all Your entries for any open Prize Draws will be voided and Your account will be closed. The Promoter will refund Your entry fees less any costs it has incurred for reaching a determination and taking action in relation to Your use or attempted use of non-manual entry methods.
1.7. If You are the Winner of a Prize Draw, the Promoter will usually allow You to enter future Prize Draws. The Promoter may refuse You entry if it determines, at its sole discretion, that You have engaged or attempted to engage in any form of actual or apparent fraud, misrepresentation, hacking, or other damaging interference with the staff, customers, or operations of the Promoter or its Website.
1.8. The Promoter may, without providing a reason,:
1.8.1. Decline to open an account for You;
1.8.2. Close Your account;
1.8.3. Refuse Your entry into a Prize Draw; and / or
1.8.4. Declare Your entry into a Prize Draw void.
2. Prize Draw
2.1. The Prize Draw gives You the chance to win a prize (the “Prize”) as detailed for each Prize Draw on the Website. Eligible Entrants can participate in a Prize Draw until the closing date (“Closing Date”) of that Prize Draw as shown on the Website. The number of available entries for a Prize Draw are subject to change from time to time.
2.2. The Promoter may close a Prize Draw early if all available entries have been purchased. If the Promoter closes a Prize Draw early, a Winner will be selected from all valid and eligible entries received prior to the Closing Date. If this is the case, the Closing Date is the date on which the Promote closes the Prize Draw.
2.3. The Promoter may cancel a Prize Draw at any time – if this is the case, the Promoter will credit Your entries to Your online account to enable You to participate in a subsequent Prize Draw and will have no further obligation or liability to You in relation to the cancelled Prize Draw.
2.4. All entries into a Prize Draw are final and no refunds or exchanges will be given by the Promoter for any reason except cancellation of the Prize Draw by the Promoter. If an Entrant’s entry fee is refunded or exchanged, any entries associated with the entry fee will be void and not eligible to win.
2.5. The Promoter’s decision on the outcome of a Prize Draw is final after which the Promoter has no further obligations to You, unless You are a Winner. No correspondence will be entered into about a Prize Draw once a Winner has accepted and received the Prize, or once the Prize Draw is cancelled.
2.6. The Promoter may, via its independent random draw service provider, give Entrants the ability to verify that their entries were included in a Prize Draw. The Promoter accepts no responsibility or liability in connection with the entry verification process provided by its service provider(s).
2.7. Unless otherwise stated on the Website, each Prize Draw on the Website is not sponsored, endorsed, or affiliated in any way with any platform used in connection with the promotion of any Prize Draw, including, without limitation, Formula 1, FIA, Facebook, Google, YouTube, Instagram, Pinterest, Reddit, SnapChat, Twitter / X, Threads, and any of their respective parents, subsidiaries, and affiliates.
3. Methods of Entering a Prize Draw
3.1. Paid Entry: To enter a Prize Draw by Paid Entry, You must register for an online account, purchase an entry, or entries (where multiple entries are permitted in a Prize Draw) for the applicable fee. You must do so by following the on-screen instructions and completing Your card information with the Website’s payment provider. When Your payment is electronically authorised and received, Your entries will be allocated to Your online account and entered into the Prize Draw.
3.2. Postal Entry: To enter a Prize Draw by Postal Entry, You must register for an online account and follow the on-screen instructions for postal entries. You are permitted only one (1) postal entry for each Prize Draw. Postal entries must be sent on a postcard using first- or second-class postage and must be received by 5:00PM UK time on the Closing Date of a Prize Draw. The Promoter will not confirm receipt of Your postal entry. The Promoter will not accept responsibility for postal entries that are lost, delayed, or damaged because of any reason whatsoever. The Promoter will not accept proof of postage as an entry into any Prize Draw.
3.3. Each entry into a Prize Draw will constitute a single entry and will have equal chances of winning as any other entry. You may be eligible to gain additional entries into a Prize Draw, offered as a special promotion at the discretion of the Promoter from time to time, when You satisfactorily complete specified activities or instructions given by the Promoter.
4. Winner Selection
4.1. One (1) Winner will be selected at random from all valid and eligible entries in a draw (“Draw”) after the Closing Date. Some Prize Draws may have runner up prizes. Winners of runner up prizes will also be selected in the Draw at random from all valid and eligible entries. Details of Draws will be announced on the Website after the Closing Date.
4.2. The Promoter will verify the Winner’s eligibility to have entered the Prize Draw, after which it will contact the Winner (via their valid email address provided upon registration on the Website) within 72 hours of the Draw to notify them that they have been selected as a winner.
4.3. A Prize may allow a Winner to use the Prize with an accompanying guest (the “Guest”).
4.4. The Winner must provide evidence of their identity and residence status in the form of valid identity and/or immigration document(s) (“identification documents”), which must match the personal details provided in the Winner’s online account.
4.5. The Winner must confirm acceptance of the Prize via email within 5 working days (the “Acceptance Period”) of the Draw. The Winner and their Guest, if applicable, must provide identification documents and sign a release letter within the Acceptance Period. If a Guest is aged below 18 years, their parent or legal guardian must provide identification documents and sign a release letter.
4.6. If a Winner is not eligible for the Prize Draw, fails to confirm acceptance of the Prize within the Acceptance Period, fails to provide the required identification documents, or is otherwise in breach of these Terms, the Winner will forfeit the Prize, and an alternative Draw will be run to select a new winner.
4.7. The outcomes of each Draw will be announced on the Website and social media page(s) of the Promoter.
5. Prize
5.1. The Prize is selected by the Promoter and the Winner cannot sell the prize, redeem it for cash, or exchange it for any other item.
5.2. The Promoter reserves the right to substitute any Prize with an alternative item of at least equal value.
5.3. The Winner takes ownership of the prize on the date that the Winner receives the Prize electronically via email. After the Winner takes ownership of the Prize, the Promoter accepts no responsibility for the Prize and has no further obligation or liability to the Winner.
5.4. The Winner is responsible for all expenses incidental to the Prize, including but not limited to: visas, travel insurance, vaccinations, transfers, meals and other incidental expenses.
5.5. The Promoter does not warrant any aspect of the Prize. If the Prize includes tickets to attend an event, the Promoter will not be responsible for any delay or cancellation of the event. Winners must correspond with the event organiser for any recourse or recompense due to them.
6. Publicity
6.1. The Winner will be required to participate in reasonable publicity required by the Promoter. The Winner agrees to pose for and provide photographs and/or videos to the Promoter which will be used in identifying them as a Winner and may be used in future marketing and public relations by the Promoter.
6.2. The Winner agrees that the Promoter may use their name (or initials and surname), town / city of residence, photographs and/or videos, or other likeness of the Winner for public relations and marketing purposes as required by the Promoter (including but not limited, on social media and the Website) .
7. Limitation of Liability
7.1. You release the Promoter (including its agents, directors, and employees) and its service providers (including advertising, social media, or other platforms) and any of their respective parents, subsidiaries and affiliates from all liability, loss or damage, or expense arising in connection with participation in any Prize Draw or the acceptance, use, or misuse of any Prizes.
7.2. If the Promoter fails to comply with these Terms, the Promoter will be responsible for loss or damage suffered by You which was a direct and obvious consequence of the Promoter’s breach of these Terms.
7.3. Save for death or personal injury as a result of the Promoter’s negligence, the Promoter (including its agents, directors, and employees) will not be liable for any loss, including economic loss, suffered by any person or property, except when it would be unlawful for the Promoter to restrict its liability.
7.4. The Promoter is not responsible, and accepts no liability, for any internet, network, electronic, hardware, or software malfunctions, failures, or other issues. For the avoidance of doubt, only entries recorded in the Promoter’s systems will be entered into the relevant Draw and the Promoter is not responsible for entries that do or do not occur because of any such malfunctions, failures, or other issues.
7.5. The Promoter is not responsible, and accepts no liability, for the acts, omissions, errors, or mistakes of any service provider.
7.6. The Promoter accepts no liability for omissions or errors in the description and details of the Prize anywhere on the Website.
7.7. The Promoter shall use reasonable endeavours to award the Prize to the correct Winner. If for any reason the Prize is awarded incorrectly, the Promoter reserves the right to reclaim the Prize and award it to the correct Winner, at its sole discretion and without admission of liability.
8. Information Protection
8.1. The Promoter receives, collects and stores any information, including personal information, You enter on the website or provide to the Promoter in any other way. This is governed by the Promoter’s Privacy Policy. By using the Website, You are deemed to have read and understood the Privacy Policy.
8.2. In order to operate the Prize Draw, the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that Your personal information continues to be adequately protected during the course of such transfer.
9. Enforceability and Breach
9.1. Each of these Terms is applicable separately. If a Court of England or other relevant authority decides that any of these Terms are invalid, unlawful or unenforceable, the remainder of the Terms will remain valid.
9.2. If the Promoter fails or delays to enforce its rights under these Terms against You, the Promoter does note waive its rights against You and You must still comply with Your obligations under these Terms.
9.3. The Promoter may waive its rights against You, and will do so in writing only. Any waiver of rights by the Promoter for Your breach of these Terms does not result in a waiver of subsequent breaches of these Terms by You.
9.4. You are responsible for compensating the Promoter and its service providers in full for any losses or damage suffered as a direct consequence of Your actions as a participant in a Prize Draw, or Your breach of these Terms.
10. Governing Law and Jurisdiction
10.1. The Promoter, its operations, and these Terms are governed by the English Law and any matters relating to them will be resolved under English Law and the Courts of England shall have exclusive jurisdiction.
